Preamble

Continuing to browse the website www.aminkader.com (hereinafter referred to as "the Site") constitutes the unconditional acceptance by the visitors of the Site (hereinafter "Users") of the following terms and conditions of use (hereinafter referred to as the "T&Cs"). Before using any features of the Site, the User acknowledges having read and accepted these T&Cs.

The currently published version of our T&Cs is the only one applicable throughout the entire period of use of the Site until it is replaced by a new version.

The Site is managed by the company SMN FRANCE (hereinafter the "Publisher"), who reserves the right to modify these terms at any time. Any use of the Site after modification of the T&Cs implies the User’s irrevocable acceptance of the new version. In case of disagreement with the T&Cs, the User is invited to cease using the Site.

ARTICLE 1 – DEFINITIONS

On the Site, the following terms have the meanings set forth below:

  • "Content": refers to all elements constituting the information available on our Site (texts, images, videos, algorithms, software, widgets, etc.) that allow its operation, the User’s information, and the presentation of our services;

  • "Intellectual Property Rights": refers to all intellectual property and related rights (copyright, trademark rights, patent rights, trade names, databases, etc.) as protected by the Intellectual Property Code created by Law No. 92-587 of July 1, 1992, with the version in force being that applicable at the time the User consults the Site;

  • "Features": refers to all functionalities made available to Users via the Site;

  • "Site": refers to the website www.aminkader.com operated by the Publisher and made available to the User;

  • "User": refers to any individual using the Site and having access to its content.

ARTICLE 2 – LEGAL NOTICE

In accordance with Law No. 2004-575 of June 21, 2004, for confidence in the digital economy, the following information is provided to Users regarding the parties involved in the creation and maintenance of the Site:

ARTICLE 3 – PROTECTION OF PERSONAL DATA

For the use of the Site, the Publisher processes certain personal data concerning Users. These processes comply with Law No. 78-17 of January 6, 1978, as amended, relating to data processing, files and freedoms (known as the "Data Protection Act") and the Data Protection Policy accessible via the corresponding tab on the Site.

ARTICLE 4 – DESCRIPTION OF SERVICES PROVIDED

The Publisher strives to provide information as accurate as possible but is not responsible for omissions, inaccuracies, or delays in updating the information. All information provided on the Site is given for guidance only and is not exhaustive; it is subject to modifications made since its publication.

ARTICLE 5 – ACCESS TO THE SITE

5.1 General provisions

Access to and use of the Site are reserved for strictly personal use. The User agrees not to use the Site and the information or data contained therein for commercial, political, advertising purposes or any form of commercial solicitation, including unsolicited emails.

Users are responsible for setting up their own IT and telecommunications means to access the Site and bear the telecommunication costs related to Internet access and Site use.

5.2 Use of Site services

The Publisher cannot be held responsible if a User provides false personal information when subscribing to services.

The User alone is responsible for the accuracy of information provided during subscription to services and agrees to update this information as needed. The Publisher's liability cannot be engaged for truncated, inaccurate, or missing data that impacts, directly or indirectly, the use of the Site.

ARTICLE 6 – INTELLECTUAL PROPERTY

6.1 The Site

All trademarks, photographs, texts, comments, illustrations, images (animated or not), video sequences, sounds, as well as all software applications used to operate the Site, and more generally all elements reproduced or used on the Site, are protected by applicable intellectual property laws.

They are the full and entire property of the Publisher, the AMIN KADER brand, or their commercial partners. Any reproduction, representation, use, or adaptation in any form whatsoever, of all or part of these elements, including software applications, without the prior written consent of the Publisher, is strictly prohibited. The Publisher's failure to take legal action upon discovering unauthorized uses does not imply acceptance of such uses or waiver of future prosecution.

It is strictly forbidden for the User to:

  • Copy, reproduce, represent, broadcast, distribute, publish, permanently or temporarily, all or part of the content and/or Site by any means and on any known or unknown medium;

  • Create derivative works from the content and/or Site;

  • Modify, translate, adapt, or arrange all or part of the content and/or Site;

  • Disassemble, decompile, or perform reverse engineering on the Site.

In any event, the User is solely responsible for their use of the Site.

Any unauthorized exploitation of the Site or any of its elements will be considered counterfeiting and prosecuted under articles L. 335-2 and following of the Intellectual Property Code.

6.2 Our brand

The verbal and visual trademarks (logos) of the Publisher are protected. Their use without written permission from the Publisher or its partners on any medium, for product or service promotion or commercial purposes, is prohibited under penalty of civil and criminal proceedings initiated by the Publisher against the User and/or responsible third parties.

6.3 Content

Some content is freely accessible on the Site. Posting this content does not transfer copyright or ownership rights, which remain the full intellectual property of the Publisher and contributors.

No User may take any action incompatible with copyright and intellectual property rights or contrary to any French or international law regarding intellectual property. The Publisher and its contributors reserve the right to pursue any User for violation of these provisions.

ARTICLE 7 – SITE MANAGEMENT

The Site is normally accessible at all times to Users. For proper management, the Publisher reserves the right at any time to:

  • Suspend, interrupt, or limit access to all or part of the Site, for any reason, with or without notice, at its sole discretion;

  • Remove any information that may disrupt the Site’s operation, for any reason, with or without notice, at its sole discretion;

  • Suspend the Site to perform updates.

The Publisher will endeavor to inform Users in advance of intervention dates and times but cannot be held liable for failure to do so.

ARTICLE 8 – LIABILITY

8.1 Access to the Site

The Publisher commits to doing its best to ensure the Site is accessible 24/7. However, the Publisher makes no guarantee of permanent availability or error-free operation. The Publisher cannot be held liable for failure, breakdown, difficulty, or interruption preventing access to the Site or any of its features.

The Publisher and the host shall not be liable for network malfunctions, telephone lines, or IT and telephony hardware issues, including network congestion preventing access to the server.

The Publisher cannot be held liable for legal proceedings against Users:

  • Resulting from the use of the Site or any other internet-accessible service;

  • Resulting from the User’s non-compliance with these T&Cs.

8.2 Equipment used

The User is solely responsible for the hardware used to connect to the Site. They must take appropriate measures to protect their equipment and personal data. The User agrees to access the Site using up-to-date, virus-free hardware and a recently updated browser.

The Publisher is not responsible for damages caused to Users, third parties, and/or their equipment due to their connection to or use of the Site, and Users waive any related claims against the Publisher.

The Publisher is also not liable for indirect damages (such as loss of market or opportunity) resulting from Site use.

ARTICLE 9 – PHOTOGRAPHS

Photographs on the Site, accompanying descriptions, are non-contractual and do not bind the Publisher.

ARTICLE 10 – HYPERTEXT LINKS

Users are authorized to create any hyperlink to all or part of the Site, subject to prior written authorization from the Publisher, requested by email at the following address: contact@aminkader.com.

The Publisher is free to refuse this authorization without having to justify its decision in any way. If the Publisher grants its authorization, it is in all cases temporary and may be withdrawn at any time, without any obligation to justify. In any case, any link must be removed upon simple request from the brand.

The Site contains a number of hyperlinks to other websites, set up with the authorization of the Publisher. However, our company does not have the possibility to verify the content of such visited sites and will therefore assume no responsibility for this.

ARTICLE 11 – PARTIAL INVALIDITY

The temporary non-application of one or more clauses of these general conditions may in no case be interpreted as a waiver by the Publisher to invoke any of said clauses.

If one or more provisions of these conditions were declared null or unenforceable by a law, regulation, or following a final court decision, the other provisions would retain all their force and scope and continue to apply fully.

ARTICLE 12 – LANGUAGE

In the event of a translation of these general conditions into one or more languages, the language of interpretation shall be French in the event of any contradiction or dispute regarding the meaning of a term or provision.

ARTICLE 13 – APPLICABLE LAW

These terms of use of the Site are governed by French law and are — in case of dispute — subject to the exclusive jurisdiction of the competent courts of ordinary law, subject to any specific jurisdictional assignment resulting from a particular legal or regulatory text.

ARTICLE 14 – SUPPORT

The Publisher’s technical team provides assistance from Monday to Friday, 10:30 AM to 6:30 PM by email only, excluding public holidays. If the User is located abroad, these hours correspond to the time zone applicable in Metropolitan France.

This support aims to provide the User with responses to malfunctions and anomalies encountered while using the Site. This support does not cover User needs related to problems with their equipment or any third-party software not provided by the Publisher.

The Publisher will not provide support services for:

  • Use of the Site by the User in a manner not compliant with these terms;

  • Abnormal use of the Site, whatever the reason;

  • Compatibility problems between the Site and the User’s computer equipment;

  • Any breach by the User of their obligations under these terms;

  • Unauthorized modifications of the Site by the User or a third party;

  • Failures of electronic communication networks;

  • Acts of deliberate damage, malice, sabotage;

  • Any deterioration due to force majeure or misuse of the Site.
